Can Private E-mails Be Public Records?

Monday, August 17th, 2009

Sometimes private e-mails can fall under the definition of public records, especially if you are a publicly elected official or employed by a public office and your private correspondence is being stored in your public office computer. This is exactly what Jim Gibbons, a politician with decades of experience, who now serves as the 28-th Governor of Nevada and formerly served as a member of the United States House of Representatives failed to foresee, but which was discovered recently and came as a surprise after the case had been brought to the Carson City District court.

Can Private E-mails Be Public Records?

Even if there’s still a controversy on this public records matter, several personal e-mails stored in the official’s computer out of more than one hundred were ruled out by the court to be disclosed following the records request filed earlier by one of the state’s newspapers. These are the e-mails the governor either sent or received from ten people as part of their private correspondence.

The public media company, Reno Newspapers, still goes ahead and proceeds with filing the appeal disputing the ruling of the district judge, apparently wishing to create a legal precedent, which must be good for citizens to have someone acting so persistently as open government law compliance and public rights watchdog. Whatever the outcome, it has already become clear that at least certain electronic communication records kept in state owned computers could be used absolutely legally for purposes like running a background check on a state official, however high position that person would hold.

From the other hand, even some citizens are as extreme in their opinions as to believe the current governor of the state of Nevada must be lacking competence in many matters, the others believe there should be reasonable measures protecting privacy of everyone. Interestingly enough, the laws of other states, like South Carolina, specifically SC Freedom of Information Act, provides that any discussion through state computers automatically creates a public document falling under the status as defined by specific public records law or laws, should even in fact be a private correspondence. Thus private e-mail is in fact no means that could help avoid open-records laws.
